Promoter<br /> </strong><br /> Mirvac BTR Sub Company A Pty Ltd as trustee for BTR Flinders Trust (Rental Provider) is offering the LIV Aston 50% Off TotalFusion Fusion and TotalFusion Membership Incentive (Promotion).<br /> <br /> <strong>2. Availability and Cap</strong><br /> <br /> a. The Promotion is available to a maximum of 50 eligible residents of LIV Aston, comprising both new and existing renters.<br /> <br /> b. The Rental Provider may, at its discretion, increase the cap to a maximum of 200 eligible residents.<br /> <br /> c. Availability of the Promotion is not guaranteed and is subject to the applicable cap at the time of acceptance.<br /> <br /> d. The Rental Provider may vary, suspend, or withdraw the Promotion at any time, subject to clause 4.<br /> <br /> <strong>3. Incentive Offer</strong><br /> <br /> Subject to these Terms and Conditions:<br /> <br /> a. Eligible renters will receive 50% off the membership fee for either the Fusion membership tier or the TotalFusion membership tier, each offered by TotalFusion, for an initial period of twelve (12) months.<br /> <br /> b. For new renters, eligibility requires entry into a new residential rental agreement at LIV Aston with a minimum initial fixed term of twelve (12) months (Agreement).<br /> <br /> c. For existing renters, eligibility requires the renter to be in occupation at LIV Aston at the time of acceptance of the Promotion and to have a minimum of twelve (12) months remaining on their residential tenancy agreement.<br /> <br /> Where the renter does not have at least twelve (12) months remaining on their current agreement, the renter must, at the time of acceptance of the Promotion, enter into a lease extension or renewal that results in a minimum remaining term of twelve (12) months.<br /> <br /> d. The Promotion applies only while the renter remains in occupation under a valid Agreement and subject to availability under the applicable cap.<br /> <strong><br /> 4. Discount Period and Changes</strong><br /> <br /> a. Following the initial twelve (12) month period, the discounted rate may continue unless the renter is notified otherwise by LIV Aston or TotalFusion Pty Ltd (TFP).<br /> <br /> b. The continuation of the discount beyond the initial period is not guaranteed and remains subject to the Rental Provider&rsquo;s and/or TFP&rsquo;s discretion.<br /> <br /> c. Any change or withdrawal of the discount will be communicated with a minimum of thirty (30) days&rsquo; written notice.<br /> <br /> d. If the discount is withdrawn, the membership fee will revert to the then‑current resident rate offered by TotalFusion after the minimum notice period has expired.<br /> <br /> <strong>5. Conditions of the Promotion</strong><br /> <br /> a.&nbsp;<span data-teams="true">The Promotion is only available to residents at LIV Aston who sign a rental agreement with the Rental Provider.</span><br /> <br /> b. The Promotion applies only to the TotalFusion Fusion and TotalFusion membership and the Reformer add‑on and excludes all other upgrades, add‑ons, personal training, retail purchases, and other services.<br /> <br /> b. The Promotion cannot be applied until this letter has been signed by both the renter and the Rental Provider.<br /> <br /> c. If a new renter&rsquo;s Agreement ends for any reason before completion of the initial twelve (12) months fixed term, the renter will forfeit any remaining benefit of the Promotion.<br /> <br /> d. The Promotion is personal to the renter, non‑transferable, and may not be assigned.<br /> <br /> e. The Promotion may only be used once per renter and cannot be combined with any other TotalFusion or LIV Aston offer unless approved in writing by the Rental Provider.<br /> <br /> f. Except as expressly set out above, the terms of the Agreement remain unchanged and continue to apply.<br /> <br /> g. This Promotion does not affect the renter&rsquo;s obligation to pay rent, bond, or any other amounts payable under the Agreement.<br /> <br /> h.The renter must not publicly disclose or advertise the Promotion without the Rental Provider&rsquo;s prior written consent (which will not be unreasonably withheld).<br /> <br /> i. These Terms and Conditions survive termination of the Agreement to the extent necessary to give them effect.<br /> <br /> j. The renter acknowledges that the Rental Provider does not provide any services on behalf of TotalFusion and that all operational matters in connection with a TotalFusion membership are a matter for the renter to resolved directly with the TotalFusion operator.
